Service Terms and Conditions for Rubbish Collection West Kensington
These Terms and Conditions set out the basis on which Rubbish Collection West Kensington provides waste and rubbish removal services to residential and commercial customers. By making a booking, accepting a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions.
If you do not agree with any part of these Terms and Conditions, you must not book or use our services. These terms apply to all services provided within our operating area and are intended to comply with applicable waste management and consumer protection laws in England and Wales.
Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, business, or organisation requesting and paying for the rubbish collection service.
Company means the operator trading as Rubbish Collection West Kensington.
Services means any rubbish collection, waste removal, recycling, clearance, loading, transport, or related activity carried out by the Company.
Booking means an order placed by the Customer for the Services, whether by telephone, email, online form, or any other method accepted by the Company.
Waste means the materials and items presented by the Customer for removal under a Booking, subject to any exclusions set out in these Terms and Conditions.
Service Description
The Company provides rubbish and waste collection services which may include household rubbish removal, bulky item collection, garden waste removal, office clearance, and general non-hazardous waste disposal. All services are subject to availability and to these Terms and Conditions.
The Company will use reasonable care and skill when carrying out the Services and will seek to handle and dispose of Waste in a compliant and environmentally responsible manner, in line with applicable UK waste regulations.
Booking Process
The Customer may request a quotation and make a Booking by contacting the Company using the communication methods made available at the time. The Customer must provide accurate information about the type, estimated volume, and location of the Waste, any access restrictions, parking requirements, and any other information reasonably required for the Company to assess the job.
Quotations may be provided based on the information supplied by the Customer and may be indicative only. The final price may be confirmed or adjusted on site after inspection of the Waste and access conditions. If the Customer does not agree to any revised quotation, the Company reserves the right not to proceed with the Service.
A Booking is accepted and a contract is formed when the Company confirms acceptance of the Booking by email, text, telephone, or other confirmation method, or when the Company attends the site and the Customer allows the work to commence.
The Customer is responsible for ensuring that a person over 18 years of age is present at the premises at the agreed time to provide access, confirm the Waste to be removed, and approve any changes to the quoted price.
Service Area and Access
The Company provides services within its designated service area, which includes West Kensington and surrounding locations as determined by the Company from time to time. Bookings outside the usual service area may be accepted at the Companys discretion and may be subject to additional charges.
The Customer must ensure that the Company has safe, clear, and reasonable access to the property and to the Waste at the agreed time. This includes providing any required entry codes, keys, permission from building management where necessary, and adequate parking or loading space near the collection point.
If the Company is unable to carry out the Services due to a lack of access, unsafe conditions, or absence of a responsible adult, the Company may treat the Booking as a late cancellation and apply charges as set out in the Cancellations and Changes section.
Waste Types and Exclusions
The Company collects most common non-hazardous waste, including general household rubbish, furniture, appliances, garden waste, and non-hazardous commercial waste, subject to vehicle capacity and legal limits.
The Company does not accept certain types of Waste, including but not limited to:
Hazardous or dangerous materials such as asbestos, chemicals, solvents, oils, gas bottles, clinical or medical waste, sharps, and flammable substances.
Pressurised containers unless previously agreed and safe to handle.
Large quantities of soil, rubble, or construction waste beyond the Companys stated capacity or weight limits.
Any item or material which it would be unlawful for the Company to collect, transport, or dispose of, or that requires a specialist license or facility beyond the Companys arrangements.
The Customer must inform the Company in advance if any Waste may present a particular handling risk. The Company reserves the right to refuse to remove any Waste that, in its reasonable opinion, is unsafe, unlawful, or outside the agreed scope of work.
Pricing and Quotations
Unless expressly stated otherwise, all prices are quoted in pounds sterling and are exclusive of any applicable taxes or charges that may be added in accordance with UK law.
Prices may be based on volume of Waste, weight, labour time, access difficulty, and disposal costs. The Company may provide a guide price in advance and confirm the final price on site once the Waste has been inspected.
If the actual amount or type of Waste differs from that described by the Customer at the time of Booking, the Company may adjust the price accordingly. The Customer will be informed of any price change before the work proceeds. If the Customer does not agree to the revised price, the Company may cancel the Service and may charge a call out or cancellation fee.
Payments
Payment terms will be communicated at the time of Booking. The Company may require payment in full on completion of the Service, or in advance, depending on the nature and size of the job.
Accepted payment methods may include cash, debit or credit card, or bank transfer, as notified by the Company. The Customer must ensure that funds are available and that any card used is authorised and valid.
Where credit terms are agreed for business Customers, invoices are payable within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date. The Company reserves the right to charge interest on overdue sums in accordance with applicable UK law on late payment, and to recover reasonable costs of debt collection.
Title to any Waste collected passes to the Company once removed from the Customers premises, subject to compliance with waste regulations. The Customer remains responsible for payment of all agreed charges even if Waste has already been collected.
Cancellations and Changes
The Customer may cancel or amend a Booking by contacting the Company using the communication methods provided. The following rules will generally apply unless otherwise agreed in writing:
If the Customer cancels more than 24 hours before the scheduled arrival time, no cancellation fee will usually be charged.
If the Customer cancels less than 24 hours before the scheduled arrival time, the Company may charge a cancellation fee to cover administrative and scheduling costs.
If the Customer cancels on arrival or after the team has been dispatched and is en route, the Company may charge a call out or minimum fee.
If the Customer is not present at the property at the agreed time, or if access is not available or is unsafe, the Company may treat this as a late cancellation and apply the relevant fee.
The Company reserves the right to cancel or reschedule a Booking at any time in case of vehicle breakdown, staff illness, severe weather, unsafe conditions, or other circumstances beyond its reasonable control. In such cases, the Company will seek to provide as much notice as reasonably possible and will offer a rebooking or refund of any advance payment for services not yet provided.
Customer Obligations
The Customer agrees to:
Provide accurate and complete information when making a Booking.
Ensure safe and reasonable access to the premises and the Waste.
Ensure that any Waste presented for collection is not hazardous or prohibited under these Terms and Conditions, or that any such Waste has been expressly agreed in writing.
Comply with any reasonable instructions given by the Companys operatives regarding safety or the placement of Waste.
Obtain any necessary permissions from landlords, neighbours, building managers, or local authorities where required for access or parking.
Liability and Damage
The Company will exercise reasonable care and skill when carrying out the Services. However, minor scuffs or marks can occasionally occur when removing bulky items, particularly in confined spaces or where access is restricted. The Customer should take reasonable steps to protect flooring, walls, and fixtures if concerned about potential damage.
The Company will not be liable for:
Any pre-existing damage or wear and tear to the Customers property.
Damage arising from the movement of items at the specific request of the Customer where the Company has advised that such movement carries a risk.
Indirect or consequential loss, including loss of profit, business, or opportunity, arising out of or in connection with the provision of the Services.
Any delay or failure to perform the Services due to events beyond the Companys reasonable control, including but not limited to extreme weather, traffic conditions, accidents, or public transport disruptions.
Nothing in these Terms and Conditions excludes or limits the Companys liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other matter which cannot lawfully be excluded or limited under UK law.
Compliance with Waste Regulations
The Company aims to comply with all applicable UK waste management and environmental regulations. Waste collected will be transported to authorised facilities for disposal, recovery, or recycling wherever practicable.
The Customer confirms that they are the owner of the Waste or have the authority of the owner to arrange for its removal. The Customer must not ask the Company to remove any Waste that has been illegally dumped by the Customer or that is subject to an ongoing investigation or enforcement action.
Where legally required, the Company will complete any necessary documentation relating to the transfer of Waste. The Customer must provide any information reasonably requested for regulatory compliance, and must not knowingly provide false or misleading information about the Waste.
The Company reserves the right to decline or stop the Service if it believes that continuing would result in a breach of waste legislation or other applicable laws.
Complaints and Disputes
If the Customer is dissatisfied with any aspect of the Service, they should contact the Company as soon as possible with details of the issue. The Company will investigate the complaint and seek to resolve it fairly and promptly.
Any disputes that cannot be resolved amicably between the parties may be referred to the appropriate courts in accordance with the Governing Law and Jurisdiction clause below.
Amendments to These Terms
The Company may update or amend these Terms and Conditions from time to time to reflect changes in law, best practice, or the scope of services offered. The latest version will apply to new Bookings made after the date of publication. For existing Bookings, the version in force at the time of Booking will generally apply, unless a change in law requires otherwise.
Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the provision of the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter, save that consumers resident in other parts of the United Kingdom may be entitled to bring proceedings in their local courts where required by applicable consumer law.
Severability
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms and Conditions, together with any written quotation or order confirmation, constitute the entire agreement between the Company and the Customer in relation to the provision of the Services and supersede any prior understandings, representations, or agreements, whether oral or written.
By proceeding with a Booking for rubbish collection with Rubbish Collection West Kensington, the Customer confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
